1. Applicability

    These terms and conditions ("Terms and Conditions") apply in the event that Saipan DataCom, Inc. ("Saipan DataCom") is directed to cancel or transfer a .MP domain name pursuant to a decision from an administrative panel of a dispute resolution service provider ("Administrative Decision") (e.g., a decision by the World Intellectual Property Organization Arbitration and Mediation Center or other dispute resolution service provider ), or pursuant to an order from a court or arbitral tribunal, in each case of competent jurisdiction, requiring such action ("Court Order"). These Terms and Conditions are effective as of January 1, 2015.

  2. Implementation of Cancellation or Transfer

    After Saipan DataCom receives an Administrative Decision or Court Order directing it to cancel or transfer a .MP domain name, it will implement that action after the challenger who initiated the action resulting in the Administrative Decision or Court Order ("Challenger") pays any administrative fees made applicable by Paragraph 3 of these Terms and Conditions. Saipan DataCom will allow a fifteen (15) day grace period after receiving any applicable fees before effectuating the cancellation or transfer. If no fees are due, the fifteen (15) day grace period will begin when Saipan DataCom receives the Administrative Decision or Court Order.

  3. Administrative Fees

    • a. Cancellation of a .MP Domain Name Used As a Traditional Domain Name. When Saipan DataCom cancels a .MP domain name, Saipan DataCom will not charge an administrative fee to cancel the .MP domain name.

    • b. Transfer of a .MP Domain Name Used as a Traditional Domain Name. When Saipan DataCom transfers a .MP domain name, the Challenger shall pay to Saipan DataCom a transfer fee of USD $50 and a new registration fee of USD $50. Payment of these fees is a condition of transfer.

  4. Effect of Non-Payment

    If a Challenger does not pay the applicable administrative fees to Saipan DataCom within thirty (30) days of Saipan DataCom's receipt of an Administrative Decision or Court Order directing cancellation or transfer, Saipan DataCom may, at its discretion, refuse to take any action with respect to the .MP domain name that was the subject of the challenge. In that event, in the case of an Administrative Decision, the Administrative Decision will become void and of no force or effect.

  5. Modification of these Terms and Conditions

    Saipan DataCom reserves the right to modify these Terms and Conditions at any time. Saipan DataCom will post its revised Terms and Conditions at at least thirty (30) calendar days before they become effective.
